Form of Declaration to be made by the widow of the deceased person who has not had a land warrant.

State of Virginia County of Russell on this 8th day of Oct 1855 personally appeared before me, a justice of the peace, within and for the county and state aforesaid, Elizabeth Burress age 55 years, a resident of Russell County in the state of Virginia who, being duly sworn according to law, declares that she is the widow of Micajah Burress, deceased, who was a private in the company commanded by captain James Hoge in the Regiment of (blank) commanded by (blank) in the war with Great Britain, declared by the United States on the 18th day of June 1812, that her said husband marched at Montgomery County on or about the day of (blank) for the term of 6 months and continued in actual service in said war for the term of 14 days and was honorable discharged at (blank) on the day of (blank). She further states that she was married to said Micajah Burress in Russell County on the 8th day of July 1849 by one Elkins Kiser a minster and that her name before her said marriage was Elizabeth Frances and that her said husband died at Russell County on the 31st day of May 1852 and that she is now a widow. She further declares that she has heretofore made application for bounty land under the act approved Sept 28, 1850. She makes this declaration for the purpose of obtaining the bounty land to which she may be entitled under the act approved the 3rd March 1855.

We John W. Dunkin and Leak Dunkin residents of Russell County in the State of Virginia upon our oaths declare that the foregoing declaration was signed and acknowledged by Elizabeth Burress in our presence, and that we believe, from appearance and statements of the applicant, that she is the identical person she represents herself to be. Dear Sir, While attending Russell Court on yesterday, the nephew of Elizabeth, widow of Micajah Burris approached me on the subject of his aunts claim for Bounty Land, I informed him of the further requirements of the department but being 10 miles from Ms. Burris and so extremely cold it was not in my power to take appointments but her nephew said she had never made application for bounty land previous to the present application and some half dozen gentlemen who know her and knew her husband, assured me, she was truly the widow of Micajah Burress and always ?? to be his lawful wife, and has not again married since his death. I merely? make this statement to you - I know it is not, as I fully imagined?, but will say to you, from the character of the gentleman, I have every reason to believe it true, they have no earthly interest in the case, they know of Micajah's death, that he is dead. I am ? Very Respectfully your Office? J.W. Glivens?

My memo book shows his claim for 160 acres that she had not claimed previously, nor had he claimed as reported to me.

Complaint of William Nash against Micajah Burress for unlawfully withholding 20 acres.

May 10th and 31st 1834 (Russell County Law Order Book, Book 10 Page 139, 10 May 1834.)

At a court called and held for Russell County at the court house on Saturday the 31st day of May 1834 for the trial of the complaint of William Nash against Michajah Burress, Defendant for unlawfully and againt the consent of the complaintant holding from him possession of a certain tenament containing by estimation 20 acres of land with the appurtance lying and being in the county of Russell.

Present John Jasper and John Senell, gentlemen justices. This day came as well the plaintiff by his attorney as the defendant in his proper person, and a jury well selected by lot to wit: Lsarah Fuller, Jacob Tool, John Kizer, James Jasper, Samuel E. Gilmore, William Gibson, James Gilmore, John Browning, Archer Jesper, Leonard Shoemaker, John Grey, and Samuel Whitsell who having been sworn to by weather the defendant against the consent of the plaintiff holds possession of the tenement mentioned in the compmlaint filed in this cause weather the said defendant hath so hold possession thereof against the consent of the plaintiff for 3 years next before the exhibition of the said complaint, and weather the plaintiff hath the right of possession in the tenement aforesaid, and to find a true verdict thereon according to the evidence, and having retired from the bar after some time returned into coury with a verdict in these words:

"We the jury find that the defendant did at the time of the exhibition of the complaint filed in this court, hold possession of the tenement therein mentioned against the consent of the plaintiff, that the defendant hath not so held possession thereof against the consent of the plaintiff for 3 years next before the exhibition of said complaint and that the plaintiff hath the right of possession in the tenement aforesaid"

Therefore it is considered by the court that the plaintiff recover against the defendant his ??? by him in this behalf expended whereupn the plaintiff pays a writ to the sheriff of Russell County to be disacted??? to cause him to have possession of the tenement aforesaid, and to him it is granted, returnable here at the next July term.

Upon the information of Joseph Counts one of the overseers of the poor, it is ordered that the children of Widow Burress and of Sally Holly who are ??? (panders, not sure what is says) be bound to some ??? persons according to law

This marriage is questionable. However, The marriage date is given by Elizabeth on a Land Bounty Widow pension she tired to collect after Micajah's death. If Rachel is the the one in Pike County Kentucky, then I'm assuming her and Micajah were still married. That Rachel died in 1855. I don't know why the separated, but perhaps Elizabeth had something to do with it? Other records for the children do list their father as "Cager Burress" so the children must be his, but since in 1849 him and Elizabeth were cited for lewdness that would infer they were not married and living together. Weather they made it legal at some later date is unclear, but Micajah died before Rachel (if indeed, she is the Rachel in Kentucky), and divorces weren't that common back then.
